PROCLAMATION

RE: CRAB, EEL, FISH AND SHRIMP POTS

Dr. Louis B. Daniel III, Director, Division of Marine Fisheries, hereby announces that effective at 7:00 A.M., Friday, May 9, 2008, the following will apply to crab, eel, fish, and shrimp pots:

Pots MAY NOT BE SET in the following area from 7:00 A.M. until 3:00 P.M. on Friday, May 9, 2008.

I. AREA
Nelson Bay–Carteret County
In an area bound by a line beginning at Marker “1” off Fulchers Creek at 34° 50.0627’N – 76° 24.4901’W; running easterly to Marker “28” at 34° 50.5456’N – 76° 22.9247’W; running northerly to Marker “1” off Sea Level at 34° 51.1820’N – 76° 23.1348’W; running to the southern point of Willis Creek at 34° 50.9301’N – 76° 24.4672’W; running southerly to the point of beginning (see map).

II. GENERAL INFORMATION:

A. This proclamation is issued under the authority of N.C.G.S. 113-170.4; 113-170.5; 113-182; 113-221.1; 143B-289.52 and N.C. Marine Fisheries Rules 15A NCAC 3H.0103 and 3J.0301.

B. It is unlawful to violate the provisions of any proclamation issued by the Fisheries Director under his delegated authority pursuant to N.C. Marine Fisheries Rule 15A NCAC 3H.0103.

C. The intent of this proclamation is to allow long haul seining to occur in an area free of crab pots. The proclamation will be used to avert user conflict between April 1 and July 30 of each year. The proclamation was approved by the Marine Fisheries Commission on July 20, 2004 in accordance with Marine Fisheries Rule 15A NCAC 3J .0301 (j).

D. Hatched area on the attached map indicates the area designated for long haul operations. Pots must be removed from this area during the times indicated above.
