RE: SHELLFISH MANAGEMENT AREA
Dr. Louis B. Daniel III, Director, Division of Marine Fisheries, hereby announces that effective sunrise, Friday, April 29, 2011, the following Shellfish Management Areas will close to the taking of shellfish.
1. The Crossrock Oyster Management Area and the “Jay” Rock OMA (also known as the lower Crossrock OMA) shown on the attached map.
2. That portion of the Galloway Flats Oyster Management Area shown on the attached map.
3. That portion of the Spring Branch Oyster Management Area shown on the attached map.
II. GENERAL INFORMATION
A. This proclamation is issued under the authority of the N.C.G.S. 113-170.4; 113-170.5; 113-182; 113-221.1; 143B-289.4 and N.C. Marine Fisheries Rules 15A NCAC 03H .0103 and 03K .0101.
B. It is unlawful to violate the provisions of any proclamation issued by the Fisheries Director under his delegated authority pursuant to N.C. Marine Fisheries Rule 15A NCAC 03H .0103.
C. This action is being taken in order to protect public health and is based on the relocation of polluted oysters into the Shellfish Management Area by the Division of Marine Fisheries. The above area will remain closed until further notice.
D. The signs on the areas affected by this proclamation will be changed from orange "Oyster Management Area-closed to Clamming"signs to green "Closed Shellfishing Area".
