PROCLAMATION

RE: SHELLFISH POLLUTED AREA

Dr. Louis B. Daniel III, Director, Division of Marine Fisheries, upon the recommendation of Leah Devlin, D.D.S., M.P.H., State Health Director, Department of Health and Human Services, hereby announces that the following shellfish area closures will take effect immediately:

No person shall take or attempt to take any oysters, clams or mussels or possess, sell or offer for sale any oysters, clams or mussels taken from the following polluted areas:

The following changes are closures to shellfish harvesting:

SHALLOTTE RIVER AREA (A-2) – Map 49

d) Holden Beach Marina – All those waters within 150 feet of the last dockage space at Holden Beach Marina beginning at a point 33º 55.0339' N -78º 16.0829' W on the shore west of the marina; running southerly to a point 33º 54.9981' N -78º 16.0701' W in the waterway; running easterly to a point 33º 55.0387' N -78º 15.9072' W in the waterway; running northerly to a point 33º 55.0741' N -78º 15.9199' W on the shore east of the marina.

MASONBORO SOUND AREA (B-6) – Map 45

b) Purviance Creek (Whiskey Creek) - All those waters of Purviance (Whiskey) Creek, Channel Haven, and all other tributaries upstream of a straight line beginning at a point 34º 09.8063' N -77º 51.1960' W on the mainland; running southeasterly to a point 34º 09.6477' N -77º 51.0182' W; running southwesterly to a point 34° 09.4871’ N -77° 51.1165’ W; running southwesterly to a point 34° 09.1252’ N -77° 51.4116’ W; running southwesterly to a point 34° 08.8788’ N -77° 51.5107’ W; running southwesterly to a point 34° 08.5913’ N -77° 51.6138’ W; running westerly to a point 34º 08.5922' N -77º 51.6606' W on the mainland.

MILL CREEK AREA (C-1) – Map 41

i) Galleon Bay Canal - All those waters within Galleon Bay canal and extending 275 feet from the last dockage space beginning at a point 34º 31.0657' N -77º 22.2362' W on shore west of the canal entrance; running northerly to a point 34º 31.0952' N -77º 22.2356' W in the sound; running easterly to a point 34º 31.0938' N -77º 22.1279' W in the sound; running southerly to a point 34º 31.0715' N -77º 22.1283' W on the shore east of the canal entrance.

j) Chadwick Acres Canal - All those waters within Chadwick Acres canal and extending 275 feet from the last dockage space beginning at a point 34º 30.8236' N -77º 23.1996' W on shore west of the canal entrance; running southeasterly to a point 34º 30.7965' N -77º 23.1813' W in the sound; running northeasterly to a point 34º 30.8316' N -77º 23.1053' W in the sound; running northwesterly to a point 34º 30.8551' N -77º 23.1211' W on the shore east of the canal entrance.

ROANOKE SOUND AREA (H-1) – Map 6

g) Old Nags Head Cove – All those waters within Old Nags Head Cove canal system and extending 650 feet from the last dockage space beginning at a point 35º 56.5871' N -75º 37.6176' W on the shore north of the canal entrance; running southwesterly to a point 35º 56.5374' N -75º 37.6961' W in the sound; running southeasterly to a point 35º 56.3908' N -75º 37.5560' W in the sound; running northeasterly to a point 35º 56.4426' N -75º 37.4740' W on the shore south of the canal entrance.

HATTERAS-OUTER BANKS AREA (H-4) – Map 8

a) Hatteras Ferry Landing Area / Sandy Bay (The Slash) Area- All those waters bounded on the west by a line beginning at a point 35° 12.7480’ N -75° 42.0510’ W north of the entrance to Teach’s Lair; running southwesterly to a point 35º 12.7085' N -75º 42.4092' W in the sound; running southerly to a point 35º 12.5263' N -75º 42.4158' W on the shore west of the ferry landing entrance; and bounded on the east by a straight line beginning at a point 35° 13.3177’ N -75° 40.6525’ W on the west shore; running easterly to a point 35° 13.2206’ N -75° 40.3188’ W on the east shore; to include all creeks, canals and tributaries.

OUTER BANKS AREA (H-5) – Map 7

h) Hatteras Colony- All those waters within the Hatteras Colony canals and extending 275 feet from the last dockage space beginning at a point 35º 22.0259' N -75º 30.2590' W on the west shore of the canal entrance; running northeasterly to a point 35º 22.0432' N -75º 30.2136' W on the eastern shore of the canal entrance.

ALBEMARLE SOUND AREA (I-1, I-3) – Map 2

i) Camden Point – All those waters within Camden Point Marina and extending 200 feet from the last dockage space beginning at a point 36º 10.5758' N -75º 58.7620' W on the west shore of the entrance canal; running easterly to a point 36º 10.5681' N -75º 58.7356' W on the east shore of the entrance canal.

j) Woodards Marina – All those waters within Woodards Marina and extending 275 feet from the last dockage space beginning at a point 35º 59.1109' N -76º 12.8828' W on the west shore of the entrance canal; running easterly to a point 35º 59.1122' N -76º 12.8750' W on the east shore of the entrance canal.

The following changes are technical revisions to closure description text:

MOREHEAD CITY AREA (E-3) – Map 31

h) McClamrock Slough - All those waters upstream from a straight line across the mouth of the McClamrock Slough beginning at a point 34° 42.2502’ N -76° 42.7640’ W on the west shore; running easterly to a point 34° 42.2541’ N -76° 42.7306’ W on the east shore.

i) Triple S Marina - All those waters upstream from a straight line across the mouth of Triple S Marina beginning at a point 34° 42.2080’ N -76° 42.6701’ W on the west shore; running easterly to a point 34º 42.2087' N -76º 42.6480' W on the east shore.

GENERAL INFORMATION:

A. This proclamation is issued under the authority of N.C.G.S. 113-170.4; 113-170.5; 113-182; 113-221.1; 143B-289.52 and N.C. Marine Fisheries Rules 15A NCAC 3H .0103 and 3K .0101.

B. It is unlawful to violate the provisions of any proclamation issued by the N.C. Fisheries Director under his delegated authority pursuant to N.C. Marine Fisheries Rule 15A NCAC 3H .0103.

C. This proclamation supersedes maps and descriptions from PA-PC-2006, dated December 18, 2006.

D. This proclamation amends N.C. Marine Fisheries Proclamation PA-PC-2006, amends Map (49) (d) and closes approximately 2 acres; Map (45) (b) and closes approximately 3 acres; Map(41) (i) and by the addition of (41) (j) and closes approximately 6 acres; Map (6) (g) and closes approximately 13 acres; Map (8) (a) by combining (8) (a) and (8) (c) and deletes (8) (c). (8) (d) becomes (8) (c), (8) (e) becomes (8) (d), (8) (f) becomes (8) (e), (8) (g) becomes (8) (f) (See Descriptions on Map) and closes approximately 5 acres; by the addition of Map (7) (h) and closes approximately 4 acres; by the addition of Map (2) (i) and (2) (j) and closes approximately 9 acres; and Map (31) (h) and (31) (i) and does not result in any additional closures.

E. These closures are due to recent sanitary surveys in the of the Shallotte River area of Brunswick County; Masonboro Sound area of New Hanover County; Mill Creek area of Onslow County; Roanoke Sound, Hatteras-Outer Banks areas of Dare County; Albemarle Sound of Currituck, Camden, Chowan, Pasquotank, Perquimans, Tyrell and Washington Counties; and the Morehead City area of Carteret County.
