PROCLAMATION
RE: SHELLFISH POLLUTED AREA

Dr. Louis B. Daniel III, Director, Division of Marine Fisheries, upon the recommendation of Leah Devlin, D.D.S., M.P.H., State Health Director, Department of Health and Human Services, hereby announces that the following openings in shellfish harvesting area will take effect at sunrise, Thursday, January 15, 2009.

The new closure descriptions for the Hurst Beach and Oriental Areas is as follows:

HURST BEACH AREA (C-4) – Map 38

a) Salliers Bay– All those waters in Salliers Bay upstream of a straight line beginning at a point 34º 33.1870' N -77º 18.4729' W on the west shore; running northeasterly to a point 34º 33.3247' N -77º 18.2224' W on the east shore.

b) Freeman Creek – All those waters in Freeman Creek upstream of a straight line beginning at a point 34º 35.8362' N -77º 15.4462' W on the west shore; running easterly to a point 34º 35.8588' N -77º 15.3226' W on the east shore.

ORIENTAL AREA (F-5) – Map 20

c) Orchard Creek – All those waters in Orchard Creek upstream of a straight line beginning at a point 35º 03.4959' N -76º 38.5585' W on the west shore; running easterly to a point 35º 03.5489' N -76º 38.4606' W on the east shore.

GENERAL INFORMATION:

A. This proclamation is issued under the authority of N.C.G.S. 113-170.4; 113-170.5; 113-182; 113-221.1; 143B-289.52 and N.C. Marine Fisheries Rules 15A NCAC 3H .0103 and 3K .0101.

B. It is unlawful to violate the provisions of any proclamation issued by the N.C. Fisheries Director under his delegated authority pursuant to N.C. Marine Fisheries Rule 15A NCAC 3H .0103.

C. This amends N.C. Marine Fisheries Proclamation PA-PC-2006, (38) (a) and (38) (c) and opens approximately 110 acres and (20) (c) and opens approximately 49 acres.

D. These openings are due to recent sanitary surveys in the Hurst Beach and Oriental Areas of Onslow and Pamlico Counties.
