PA-18-2009 PROCLAMATION RE: SHELLFISH POLLUTED AREA Dr. Louis B. Daniel III, Director, Division of Marine Fisheries, upon the recommendation of Jeffrey P. Engel, M.D., State Health Director, Department of Health and Human Services, hereby announces that the following shellfish area closures will take effect immediately: No person shall take or attempt to take any oysters, clams or mussels or possess, sell or offer for sale any oysters, clams or mussels taken from the following polluted areas: The following changes are closures to shellfish harvesting: SNEADS FERRY AREA (C-2) – Map 39 New River Landing Marina – All those waters in the New River Landing Marina basin and within 275 feet of the last dockage space beginning at a point 34º 34.6430' N -77º 23.8792' W on the shore west of the marina canal entrance; running easterly to a point 34º 34.6450' N -77º 23.8371' W on the shore east of the marina canal entrance. Piney Island Docking Facility - All those waters in the Piney Island Dockage Facility canals and within 200 feet of the last dockage space beginning at a point 34º 58.8152' N -76º 25.8696' W on the shore west of the facility; running southeasterly to a point 34º 58.7342' N -76º 25.8232' W in the bay; running northeasterly to a point 34º 58.7613' N -76º 25.7530' W on the shore east of the facility. GENERAL INFORMATION: A. This proclamation is issued under the authority of N.C.G.S. 113-170.4; 113-170.5; 113-182; 113-221.1; 143B-289.52 and N.C. Marine Fisheries Rules 15A NCAC 3H .0103 and 3K .0101. B. It is unlawful to violate the provisions of any proclamation issued by the N.C. Fisheries Director under his delegated authority pursuant to N.C. Marine Fisheries Rule 15A NCAC 3H .0103. C. This proclamation supersedes maps and descriptions from PA-PC-2006, dated December 18, 2006. D. This proclamation amends N.C. Marine Fisheries Proclamation PA-PC-2006, by the addition of Map (39) (g) and closes approximately 1 acre; and Map (23) (c) and closes approximately 61 acres. E. These closures are due to recent sanitary surveys in the of the Sneads Ferry area of Onslow County and the West Bay area of Carteret County.
