PROCLAMATION RE: SHELLFISH POLLUTED AREA Dr. Louis B. Daniel III, Director, Division of Marine Fisheries, upon the recommendation of Jeffrey P. Engel, M.D., State Health Director, Department of Health and Human Services, hereby announces that the following changes in shellfish harvesting areas will take effect at sunrise, Thursday, November 26, 2009. All those waters in Pender, Onslow, Carteret, Pamlico, Beaufort, Hyde and Dare counties will return to the status in existence immediately prior to the November 11 and 12, 2009 temporary closures with the following exceptions, which will remain closed: All those waters between ICWW marker “71” near western Holden Beach and FL Beacon #48A near eastern Holden Beach in Brunswick County. All those waters bordered on the east by a line running from the mainland through ICWW Marker #15 to a point on West Onslow Beach near Galleon Bay, and bordered on the southwest by a line running from the mainland through ICWW Marker #45 and Permuda Island in Stump Sound to a point near Surf City (see map). Freeman Creek – All those waters in Freeman Creek upstream of a straight line across the mouth. All those waters from the Intracoastal Waterway to the mainland between ICWW Fl. Beacon #59 and ICWW Fl. Beacon #55, to include Bear Creek (see map). All those waters bordered on the west by a line running from the mainland through ICWW Fl. Beacon #55 following the eastern shore of Sanders Creek to the western tip of Bear Island and bordered on the east by a line running from the mainland through ICWW Fl. Beacon #49 following the western shoreline of West Channel to the eastern tip of Bear Island, to include Queens Creek (see map). All those waters from the ICWW Waterway to the mainland between ICWW FL. Beacon #49 and the Emerald Isle Bridge, to include White Oak River (see map). Newport River – All those waters in Newport River upstream of a straight line from Crab Point to the southwest shore of Core Creek. North River – All those waters in North River upstream of the North River Bridge. Long Bay – All those waters in Long Bay upstream of a straight line from the north shore of Fur Creek running easterly to Swimming Point. Pungo River – All those waters upstream of a straight line beginning at Old Field Point on the west shore of Pungo River running southeasterly to the south shore of Fortescue Creek on the east shore of Pungo River. Wysocking Bay – All those waters in Wysocking Bay upstream of a straight line between Mackey Point and the south shore of Lone Tree Creek. A. This proclamation is issued under the authority of N.C.G.S. 113-170.4; 113-170.5; 113-182; 113-221.1; 143B-289.52 and N.C. Marine Fisheries Rules 15A NCAC 03H .0103 and 03K .0101. B. It is unlawful to violate the provisions of any proclamation issued by the N.C. Fisheries Director under his delegated authority pursuant to N.C. Marine Fisheries Rule 15A NCAC 03H .0103. C. This proclamation returns the following areas to normal closure boundaries: a portion of Stump Sound, New River, a portion of those waters between ICWW Marker #65A and the Emerald Isle Bridge, South River, Adams Creek, Neuse River, Broad Creek, Pamlico River, Rose Bay and Stumpy Point Bay D. These reopenings are due to satisfactory bacteriological sampling results.
