PA-52-2008 PROCLAMATION RE: SHELLFISH POLLUTED AREA Dr. Louis B. Daniel III, Director, Division of Marine Fisheries, upon the recommendation of Leah Devlin, D.D.S., M.P.H., State Health Director, Department of Health and Human Services, hereby announces that the following change in shellfish harvesting areas will take effect at sunrise, Friday, June 20, 2008. The following areas in Carteret County will be opened to shellfishing on a temporary basis: CARTERET COUNTY NORTH RIVER AREA Davis Bay - All those waters in Davis Bay and Turner Creek north of a line beginning at a point on the west shore at 34° 43.0360’ N -76° 37.4466’ W; thence in an easterly direction across the channel to a point on marsh at 34° 43.2134’ N -76° 36.8888’ W with the exception of all those waters in Howland Rock Canal and within 200 feet of the dockage in the canal which will remain closed (see map). Cow Pen Creek - All those waters outside the entrance to Cow Pen Creek. All those waters in Cow Pen Creek upstream of a straight line across the mouth beginning at a point 34º 44.8187' N -76º 37.4748’ W on the north shore; running southerly to a point 34º 44.7779' N -76º 37.4847' W on the south shore will remain closed (see map). North River – All those waters in North River above the North River Bridge up to a straight line beginning at a point on the west shore at 34° 48.3965’ N -76° 37.3219’ W; running easterly across the river to a point on the east shore at 34° 48.4727’ N -76° 37.0699’ W (see map). GENERAL INFORMATION: A. This proclamation is issued under the authority of N.C.G.S. 113-170.4; 113-170.5; 113-182; 113-221.1; 143B-289.52 and N.C. Marine Fisheries Rules 15A NCAC 3H .0103 and 3K .0101. B. It is unlawful to violate the provisions of any proclamation issued by the N.C. Fisheries Director under his delegated authority pursuant to N.C. Marine Fisheries Rule 15A NCAC 3H .0103. C. These openings are due to satisfactory bacteriological sampling results of both water and shellfish meats.
